### Terms of Use

### **General**
Orgad H.S.N. Ltd. (hereinafter: “Orgad H.S.N.”) is the owner and operator of the “Burgeranch” restaurant chain. It hereby launches a website for the delivery ordering service via the website and application (hereinafter: “the Website”).

The use of the Website is subject to the user’s (hereinafter: “the User” and/or “the Customer”) agreement to use it in accordance with the rules detailed below, as well as in accordance with the provisions of any law, including but not limited to, provisions applicable to the use of websites, as they may be from time to time (hereinafter: “the Legal Provisions”).

Below are the rules for using the Website. Using the Website signifies confirmation and agreement to accept these Terms of Use and a commitment to act in accordance with them, as well as in accordance with the Legal Provisions.

In the event of a violation of the Terms of Use, Orgad H.S.N. and/or anyone on its behalf and/or any authority may terminate the User’s access and/or take various measures, including legal proceedings. The Terms of Use are written in the masculine gender for convenience purposes only, but are intended for both men and women alike.

### **Delivery Service**

Product prices and the variety offered for delivery and self-pickup differ from the in-restaurant menu.

Ordering a delivery is conditional upon filling in the User’s details in the registration form on the Website. The User must fill out this registration form during the initial use of the Website. The User undertakes to provide full, correct, and accurate details, including but not limited to: name, ID number, address, phone number, and email address. You must not use the Website while assuming a false identity and/or impersonating another person. Providing false details is a criminal offense, and anyone doing so is subject to criminal and civil proceedings.

Providing the User’s personal details and other data on the Website or via the call center shall constitute consent and permission for Orgad H.S.N. to use them for advertising purposes and for the provision of services through this Website or via text messages, including improving general services, as well as consent to receive messages, notifications, correspondence, questionnaires, periodic check-ups, surveys, etc., intended to improve them and to improve the service provided to Burgeranch customers.

Orgad H.S.N. will make deliveries to the User’s address in defined delivery areas only. It is clarified that the delivery service is limited to specific distribution areas, and Orgad H.S.N. may change these areas from time to time without prior notice.

The delivery ordering service on the Website is adapted to the delivery operating hours of the branches and is subject to change from time to time without prior notice. The estimated arrival time will be indicated when placing the order, depending on the order time and the branch from which the order was placed. In any event, Orgad H.S.N. disclaims responsibility for delays in product delivery due to circumstances beyond its control that prevent the delivery from arriving on time, including the provision of false or inaccurate details by the customer, road closures, traffic blocks by external parties, natural disasters, national emergencies, or severe weather. This list is partial and not exhaustive.

The delivery ordering service on the Website is conditional upon a minimum order amount as displayed on the Website or in the app at the time of placing the order, excluding the delivery fee, which will be charged for each delivery order.

Accepted payment methods on the Website are credit cards or cash.

* **Credit Card:** Approval of the order is conditional upon the use of a valid credit card and approval by the credit card company.
* **Cash:** Approval of the order is conditional upon the customer’s identification on the Website via a code that will be sent via text message to the mobile phone number provided. It is clarified that completing the identification on the site serves as proof of the order, the customer cannot deny the transaction, and they will be charged the full amount. In accordance with the law, it is not possible to cancel a product ordered via this website, and any cancellation by the customer shall be at their own risk.

The prices published on the Website are at the sole discretion of Orgad H.S.N., and it reserves the right to change prices. Furthermore, the customer cannot express any objection and/or claim regarding the prices, and a claim that the price for a direct purchase at one of the branches is lower shall not serve as grounds for cancelling the transaction.

### **Self-Pickup**
Orgad H.S.N. will allow the User to collect orders from branches located in the defined delivery areas. In the event of choosing self-pickup, the responsibility for collecting the product and the arrival time falls solely on the User. Orgad H.S.N. will hold the product ordered for self-pickup for up to 10 minutes after the time specified by the customer. Orgad H.S.N. disclaims responsibility for non-collection, and if a customer fails to arrive for self-pickup, they will be charged the full payment for the product.

### **Website Content**
This Website may contain information that Orgad H.S.N. chooses to provide as a service to the public, including links to various other sites, forums, surveys, statistics, analyses, assessments, or any other information. This information is provided without warranty, should not be considered a recommendation for action, and should not be relied upon without further verification.

Orgad H.S.N. shall not be liable for any direct and/or indirect damage to the body and/or property of a User and/or third party caused by or in connection with the use of the Website, its content, reliance upon it, including the influence of content on a user and/or third party, and/or its influence on software, hardware, or end equipment through which it was received.

### **Website Management**
Orgad H.S.N. reserves the right to change the Website from time to time, and to make any design, content, or other changes. Orgad H.S.N. reserves the right to close the entire site or parts of it, or terminate its operation. Orgad H.S.N. is not obligated to provide prior notice of any changes.

### **Copyright**
The copyrights, intellectual property, and all other rights on the Website, its design, the software used, the text, and any other information contained therein belong and will remain solely with Orgad H.S.N. It is forbidden to copy, distribute, publicly display, or transfer any of these to a third party without prior written consent from Orgad H.S.N. Trademarks appearing on the site are the property of Orgad H.S.N. or, if published by authorized advertisers, the property of those parties. In no case may trademarks be used without written consent from their owners.

### **User Responsibility**
A User who uses the Website in violation of the Terms of Use or the law shall be solely responsible for their actions, including for any direct and/or indirect damage caused to Orgad H.S.N. or any other person.

A User in violation shall be required to compensate and indemnify Orgad H.S.N., its employees, directors, shareholders, or anyone on their behalf for any direct and/or indirect damage, including loss of profit, payment, or expense incurred—including legal fees and court costs—upon first demand.

Orgad H.S.N. may terminate access to the Website in case of any action in violation of these rules/law; however, the lack of termination does not absolve the user of responsibility.

### **Cancellation of Transaction**
Cancellation of a transaction is in accordance with the Consumer Protection Regulations (Transaction Cancellation), 2010, and the Consumer Protection Law, 1981.

### **Exemption from Liability**
Exemption from liability for Orgad H.S.N. means exemption from any liability for direct or indirect damage to the user and/or third party. This exemption applies to subsidiaries, affiliates, related companies, shareholders, directors, officers, management, employees, and anyone acting on their behalf, whether or not explicitly mentioned.

Images are for illustration purposes only.

### **Menu Structure**
Upgrading a meal increases the sides and drinks only, excluding bottled drinks.

## Privacy Policy

We at Burgeranch (Orgad H.S.N. Ltd.) value our customers’ privacy and are committed to protecting it. This document consolidates how we collect, use, and store information in our databases when you use our website, application, or self-service kiosks at the branches.

To use our services, you confirm that: (1) You are over eighteen and have the legal capacity to enter into a binding agreement; or (2) You have been given express consent by a guardian who meets the conditions of clause (1).

Please read this document before using the site/app/kiosks. The Terms of Use are an integral part of this document, as is the Loyalty Club regulation.

**Agreement:** Using the site confirms your agreement to this privacy policy. If you do not agree, please refrain from using the site. Use of your information will be done strictly in accordance with local laws.

**Collection and Use of Information:** We may collect or you may be asked to provide data such as full name, email, phone number, branch preference, residence, event details, and other information to: (1) Process delivery or self-pickup orders; (2) Contact via “Contact Us”; (3) Submit job applications; (4) Book events; (5) Recruit franchisees; (6) Provide chat support. Information is necessary to provide these services.

You acknowledge that your info will be used for service management, marketing, and improving the experience. You may opt out of data processing for these purposes by emailing privacy@bk.co.il, noting that this may impact service quality. You are not legally required to provide personal information.

**Cookies:** Our site uses “Cookies” (pixels, web beacons, Google Analytics, etc.) for operational purposes, data security, statistics, fraud prevention, and to customize your experience and advertising. By changing your browser settings, you can block cookies, but this may cause some services to malfunction.

**Payments:** When paying by credit card, you are required to enter card details. We use high-standard encryption (PCI compliance). If you choose to save card details, they are saved by the clearing company, not on Burgeranch servers.

**Location Data:** You will be offered to enable GPS for branch location services. We do not store these location data.

**Third Parties:** We do not share your personal details with advertisers. We may share non-identifiable statistical data for development and advertising on third-party platforms.

**Cloud Services:** We may use cloud services which may have servers located outside Israel. These providers are not allowed to use your data for their own purposes.

**Loyalty Club:** Joining the club represents consent to receive marketing communication (email/phone/SMS). You may opt-out by clicking the “Unsubscribe” link in the messages or by emailing privacy@bk.co.il.

**Disclosure:** We will not pass your information to third parties except: (1) At your request/consent; (2) For service provision; (3) In case of Terms of Use violations; (4) Per legal requirements/court orders; (5) To prevent damage; (6) In the event of a merger/acquisition; (7) Statistical data for third-party advertisers.

**AI Technology:** We may use AI (e.g., Chatbots) to improve service. Data collected (usage, IP, location) during these interactions is subject to this policy.

**Right to Review:** You have the right to review the information held about you in our database and request corrections or deletions by contacting privacy@bk.co.il.

**Security:** We implement updated security procedures, though no online activity is 100% immune.

**Changes:** We may update this policy. Significant changes will be announced on the site. Continued use indicates your agreement to these changes.
